Overview

In the Commonwealth of Kentucky, claims arising from a workplace injury are governed by a complex set of statutes known as the Workers' Compensation Act. The Act is administered by the Department of Workers' Claims, a division of the Kentucky Labor Cabinet. Under state law, workers' compensation is an "exclusive remedy", which means that employees generally do not have the right to sue their employers in civil court for damages. If a settlement cannot be reached in a workers' compensation dispute, the next step is to file an application for adjustment with the Department of Workers' Claims. After the application is filed, the case is assigned to an Administrative Law Judge, and after a period of litigation, a final hearing is held if the parties are still unable to reach a settlement.
